Apex (the website getapex.live and the Apex apps) is provided by Rosini Transports et Locations Sàrl (Rosini Solutions), based in Switzerland ("Apex", "we"). Contact: hello@rosinisolutions.com.

By creating an account or using Apex, you agree to these Terms of Use. Our Privacy Policy explains how we handle your personal data. If you do not agree, please do not use Apex.

Apex is an AI-assisted training platform that offers adaptive training plans, workout logging, AI coaching, recovery and health-metric analysis, nutrition guidance and wearable integrations. It is intended for healthy adults aged 18 and over.

You must provide accurate information and keep your login details confidential. You are responsible for activity on your account. Tell us immediately at hello@rosinisolutions.com if you suspect unauthorised use. Accounts are personal and may not be shared.

4.1 Plans and trial. Apex offers paid plans (monthly or annual) and may offer a free trial. If you do not cancel before the trial ends, the subscription starts and you are charged the price shown at sign-up. The price, billing period and renewal terms are shown before you buy.

4.2 Renewal and price changes. Subscriptions renew automatically until cancelled. We will notify you of any price increase at least 30 days in advance; you can cancel before it takes effect.

4.3 Cancellation. You can cancel at any time (in the app settings, or in your Apple/Google account for in-app purchases). Cancellation takes effect at the end of the current billing period, and you keep access until then.

4.4 Right of withdrawal (EU/EEA and UK consumers). You may withdraw from a paid subscription within 14 days of purchase. If you ask us to start the service immediately, you acknowledge that you lose the right of withdrawal once the digital service has been fully provided, and that a proportionate amount may be charged for the period used. Purchases made through Apple or Google follow their refund procedures.

4.5 Refunds. Other than above or where required by mandatory law, we do not refund partial periods.

You agree not to: use Apex unlawfully; post content that is illegal, harmful or infringes others' rights; attempt to reverse-engineer, copy or redistribute the platform; access systems without authorisation; or scrape data with automated tools. We may suspend accounts that seriously or repeatedly breach these rules.

Apex is a training platform, not a medical service. Plans, AI answers and nutrition information are general guidance based on the data you provide and are not medical advice, diagnosis or treatment. Consult a qualified health professional before starting a programme, especially if you have a medical condition, injury, or are pregnant. Stop exercising and seek medical help if you feel pain, dizziness or shortness of breath.

AI-generated content is produced automatically and may be inaccurate or incomplete. Treat it as a suggestion, use your own judgement and do not rely on it for medical decisions.

You keep ownership of the content you create (workouts, photos, posts). You grant us a limited licence to store, process and display it only to provide Apex to you and, for content you choose to make public, to other users. You can delete your content and your account at any time.

The Apex brand, software, interfaces, programmes and texts belong to us or our licensors and are protected by law. You may use them only within the service.

We provide Apex with reasonable care but cannot guarantee uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for intent, gross negligence, injury to life or health, or any liability that cannot be limited under mandatory consumer law.

These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Courts at our registered office in Switzerland have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts (for example under the EU rules, the UK rules or the Brazilian Consumer Defence Code).

EU consumers can also use the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr). We are not obliged to take part in alternative dispute resolution, but we will always try to resolve complaints directly — write to hello@rosinisolutions.com.

We may update these terms for legal, security or service reasons. We will notify you of material changes at least 30 days in advance. If you do not agree, you can cancel and delete your account before the changes take effect. You may stop using Apex and delete your account at any time.
